SECTION 7: APPEALS
ARTICLE 1 - GENERAL PROVISIONS
Paragraph 1 -
Any person desiring to contest a parking citation may file an appeal. The appeal must be submitted to Parking Services within ten (10) calendar days after the violation date. All matters relating to a parking notice may be disputed, with the exception of the amount of the fine(s).
Paragraph 2 -
Subject to the provisions of 7-1-3, any person who fails to file an appeal within the prescribed time waives their right to an appeal and subjects themself to the monetary fine and penalties.
Paragraph 3 -
If an appeal is made after the time period prescribed in 7-1-1, an appeal may be granted by the Director of Parking Services, depending upon an explanation in writing of any extenuating circumstances and the Director’s allowance of that explanation.
Paragraph 4 -
Any person who files an appeal will be afforded the option to present evidence. The appeal will be reviewed on the basis of their written statement and evidence.
Paragraph 5 -
Parking Services shall administer the appeals program.
Paragraph 6 -
The amount of the fine on each parking notice upheld as a result of an appeal should be paid at Parking Services immediately. Unpaid fees will be handled through normal billing processes.
Paragraph 7-
If a customer who has appealed a citation would like to contest Parking Services' decision to uphold the citation, the customer has the option of submitting a Formal Appeal.
Paragraph 8 -
All moving violations written by the SWAGÊÓƵ Police Department must be appealed via the formal appeal process. Parking Services employees do not review moving violations written by police officers.
Paragraph 9 -
For Formal Appeals the Appeals Officer's decision is final.
ARTICLE 2 - APPEALS OFFICER
Paragraph 1 -
The Appeals Officer may be a member of the University community or of the community at large.
Paragraph 2 -
The Appeals Officer will be approved by the Director of Parking Services.
Paragraph 3 -
The Appeals Officer shall hear all classes of violations and shall have the authority to uphold, amend, or dismiss the fine.
